- As a law professor-economist, I have been consulted by increasing
- numbers of practicing lawyers who have difficulty in assessing the
- real values of future streams of payments offered by insurance
- companies during settlement discussions. The value of such offers is,
- indeed, difficult to judge without fairly complex calculations. The
- tendency is for most people to greatly overestimate the lump-sum
- equivalent of future payment streams and the resultant poor advice may
- be an emerging source of malpractice claims.

- The SETTLE$.WKS template is a rather preliminary effort of mine
- to let IBM owners evaluate such offers for themselves and print out an
- analysis in less than 2 minutes. As an exercise, use the template on
- the following problems:

- * In a medical malpractice claim, part of the proffered settlement
- is an annuity of $1000 per month for life, payable starting at age
- 18 to a young black boy who has just passed his 2nd birthday. How
- much reduction in "up front" or immediate damage payments could
- reasonably be accepted in exchange for this annuity feature?

- * Or, how much is $300 per month for life, 10-years guaranteed, worth
- to a 33 year old white woman if the payments do not start until 5
- years from now? Would she be better off with a $20,000 immediate
- award?

- [Note: Long-term Treasury bonds have been up around 12.5% in Spring 1984.]

- The present preliminary version is, I believe, computationally
- debugged. But you, of course, use it at your own risk! If anyone
- can't understand how to use it ---even after good faith puzzling over
- some sample printouts-- I will give a BRIEF oral explanation (on YOUR
